VCGamers Donate Terms and Conditions

VCGamers Donate is a service provided by VCGamers to help Creators receive financial support from the community, fans, and other Users through the VCGamers Platform.

Through this service, donors can provide direct support to creators using available payment methods. Support is voluntary and intended as a token of appreciation, community support, or contribution to the creator's activities.

By accessing, registering, or using VCGamers Donate, you declare that you have read, understood, and agree to all the terms and conditions stated in this document.

If the User does not agree to some or all of the provisions contained in this document, the User is not permitted to use the VCGamers Donate service.

Definition

In these Terms and Conditions, the following terms have the following meanings:

VCGamers is a digital platform managed by VCGamers which provides various digital services, including the VCGamers Donate service.

Platform is a website, application, system, service, or feature provided by VCGamers.

User is any individual or legal entity that accesses and uses the Platform.

Donors is a User who makes a Donation to a Creator via VCGamers Donate.

Creator is a User who receives Donations through VCGamers Donate.

Donation is a voluntary donation of funds by Donors to Creators through the Platform.

Creator Balance is the donation fund that has been received and recorded in the VCGamers system after deducting applicable fees.

Disbursement of funds is the process of transferring Creator Balance to a bank account or other available payment method.

Content is all information, text, images, videos, audio, links, messages, or other materials uploaded or displayed on the Platform.

General Terms of Use

Users must be at least 18 (eighteen) years old or have obtained permission from a parent or legal guardian.
Users are required to have an active VCGamers account to use certain services within VCGamers Donate.
Users are required to provide accurate, correct, complete and up-to-date information.
Users are responsible for all activities carried out through their accounts.
Users are required to maintain the security of their accounts, passwords, OTP codes, and other authentication information.
VCGamers reserves the right to carry out identity verification, account verification, or additional checks at any time if deemed necessary.
Users are prohibited from using the service for purposes that are contrary to law, public order, or policies applicable to the Platform.

Terms of Service

Scope of Services

VCGamers provides a platform that facilitates interaction between Creators and Donors through the Donate service and other services available on the Platform.

Donations are a service that provides support in the form of financial contributions to Creators. Donations may or may not include rewards determined by the Creator. All transactions are voluntary and non-refundable, unless required by applicable law.

Changes and Termination of Services

VCGamers reserves the right to change, add, delete, or stop any or all of the services, either temporarily or permanently, with or without prior notice.

Users understand that VCGamers is not responsible for any impacts arising from changes or termination of services as long as they comply with applicable legal provisions.

Compliance with Policy

Users are required to comply with these Terms and Conditions, the Privacy Policy, and other policies applicable to each feature on the VCGamers Platform.

User Responsibilities

Users are fully responsible for all activities in their respective accounts, including transactions, content, and information submitted.

Users are prohibited from using the service for illegal purposes, harming other parties, or violating Platform policies.

Prohibitions on Use of Services

Users are prohibited from using the VCGamers Donate service for purposes or activities that are unlawful, detrimental to others, or contrary to Platform policies. Specifically, Users are prohibited from doing the following:

Illegal Activities and Fraud

Committing fraud, embezzlement, money laundering, carding, or other illegal financial activities.
Using the service for fictitious transactions, Donation manipulation, or payment system engineering.
Performing chargebacks or canceling transactions without a valid basis.
Using a fake identity or someone else's without permission.

Misuse of Systems and Platforms

Carrying out hacking, exploiting system vulnerabilities, or activities that compromise the security of the Platform.
Accessing systems, data, or accounts without permission.
Using bots, scripts, or automation to manipulate Platform transactions or activities.
Taking any action that could overload, damage, or disrupt VCGamers' servers and infrastructure.

Prohibited Content

Uploading or distributing pornographic content, child exploitation, extreme violence, or explicit nudity.
Content containing hate speech, SARA, discrimination, or provocation of conflict.
Content that encourages or facilitates criminal or unlawful acts.
Content that infringes the copyright, trademark, or other intellectual property rights of others.

Abuse of Donate Transactions

Directing Donors to make Donations in a misleading, coercive, or manipulative manner.
Creating fake donation schemes or fictitious fundraising activities.
Using Donations for purposes other than those informed to the Donor.
Doing Donation engineering to increase the balance unreasonably.

Prohibited Products and Activities

Gambling or activities related to illegal betting.
Narcotics, illegal drugs, or drugs without official permission.
Firearms, explosives, or other dangerous goods.
Counterfeit goods, trademark infringement products, or other illegal products.
Activities that violate the laws and regulations in force in Indonesia.

Reputational Violations and Other Abuses

Using the Platform to harm the reputation of VCGamers, other users, or third parties.
Spreading false, slanderous, or hoax information regarding the Platform or other users.
Abusing Platform features for unauthorized personal gain.
Selling, transferring, or exploiting the service without the written permission of VCGamers.

Consequences of Violation

VCGamers reserves the right to take action against violations of these provisions, including but not limited to:

Warning to users
Content removal
Account suspension or blocking
Freezing or withholding of funds
Reporting to the authorities if necessary

Creator Rights and Obligations

By activating and using the VCGamers Donate service, Creators have the right to:

Receive Donations from Donors through the Platform.
Access features and services available to Creators in accordance with applicable provisions.
View transaction history, Donation reports, and balance information available on the Creator account.
Submit a request for disbursement of funds in accordance with the procedures and provisions applicable on the Platform.

As a service user, Creators are required to:

Provide correct, accurate, complete and up-to-date data, information and documents.
Maintain account security and be responsible for all activities carried out through the account.
Comply with all terms of service, Platform policies, and applicable laws and regulations.
Fully responsible for all content, information, campaigns, and activities published through the Donation page.
Do not use the service for purposes that are unlawful, misleading, detrimental to other parties, or contrary to the Platform's terms.

The Creator understands and agrees that all programs, prizes, rewards, benefits, promotions, and other forms of appreciation offered to Donors are the full responsibility of the Creator.

VCGamers is not responsible for relationships, agreements, implementation of promises, or disputes that occur between Creators and Donors outside the service functions provided by the Platform.

Rights and Obligations of Donors

By using the VCGamers Donate service, Donors have the right to:

Donate to Creators through the Platform.
Get information regarding the status and history of Donation transactions.
Submit questions, reports, or complaints regarding the use of services through the official channels provided by VCGamers.

As a service user, Donors are required to:

Provide correct, accurate and up-to-date data and information when making transactions.
Confirm the identity of the target Creator, the donation amount, and transaction information before making a payment.
Use valid and legally owned payment methods.
Comply with all terms of service, Platform policies, and applicable laws and regulations.
Do not carry out fake transactions, manipulate transactions, misuse payment methods, chargebacks without a legitimate basis, or other activities that are detrimental to the Platform or other users.

Donors understand that Donations are given voluntarily to Creators and in principle cannot be cancelled or requested back once the transaction has been successfully processed.

VCGamers Rights and Obligations

As a VCGamers Donate service provider, VCGamers has the right to:

Verify user data and identity at any time, including requesting necessary supporting documents.
Suspend, restrict, freeze, or deactivate user accounts that are proven or suspected of violating the Terms and Conditions, applicable laws, or internal policies.
Remove or modify content that is deemed to be unlawful, violates third party rights, or does not comply with Platform policies.
Make changes, adjustments, restrictions, or termination of some or all of the services with or without prior notice.
Withhold, cancel, or reject transactions or disbursements of funds if indications of suspicious activity, fraud, violations of the law, or misuse of services are found.
Charge service fees, transaction fees, fund disbursement fees, and other fees in accordance with applicable provisions.

As a service provider, VCGamers is obliged to:

Providing and maintaining services so that they can be used by users in accordance with the applicable Terms and Conditions.
Maintain the security and confidentiality of user personal data in accordance with the Privacy Policy and applicable laws and regulations.
Process transactions and disburse funds according to applicable procedures, unless there are technical problems, investigations, or other circumstances beyond VCGamers' control.
Notify users of significant changes to services, policies, or Terms and Conditions.
Handle user reports, questions and complaints through official support channels provided by VCGamers.

Payment and Withdrawal Terms

Payment Terms

VCGamers is not a payment gateway provider. All donation transactions made through the Platform are processed by payment service providers who collaborate with VCGamers and are licensed in accordance with applicable laws and regulations.

By making transactions through VCGamers Donate, Users understand and agree that payment transactions are also subject to the terms and conditions set by each payment service provider.

Transaction records recorded in the VCGamers system and/or payment partner systems are valid evidence of the success or failure of a transaction.

If there are any problems or disputes regarding payments, Users can contact VCGamers customer service to get assistance and follow-up according to applicable procedures.

Donation Terms

Donations that have been successfully processed are final and cannot be cancelled or returned (non-refundable), unless required by applicable law or based on VCGamers policy after an investigation has been carried out.

VCGamers has the right to reject, withhold, cancel, or review transactions that are suspected of violating the law, containing elements of fraud, misuse of payment methods, suspicious activity, or violations of these Terms and Conditions.

Withdrawal Terms and Conditions

Donation funds received will be recorded as Creator Balance on the Platform.

Fund disbursement can only be done by Creators who have completed the account verification process according to applicable provisions.

Fund disbursement can only be made to a bank account or other payment method registered in the Creator's name and has been verified by VCGamers within 1×24 business hours.

VCGamers reserves the right to set minimum and maximum limits, withdrawal schedules, and other requirements related to the withdrawal process.

VCGamers has the right to delay, withhold, or refuse disbursement of funds if:

There are indications of violations of the law or Terms and Conditions;
There is suspicious activity or suspected fraud;
An investigation or transaction dispute is underway;
There is a request from the authorities;
Account verification data discrepancies were found.

VCGamers is not responsible for any delays in disbursement caused by banking system constraints, payment partners, or other factors beyond VCGamers' control.

Payment & Service Fees

Service Fees

Creators are charged a service fee by VCGamers for each Donation received through the Platform in accordance with applicable provisions.
In addition to service fees, transactions may also be subject to payment processing fees in accordance with the terms of the payment service provider collaborating with VCGamers.
Payment processing fees may be charged to the Donor or borne by the Creator in accordance with the settings available on the Platform.
If a payment processing fee is charged to the Donor, the fee will be added to the total payment amount when the transaction is made.
The amount of service fees, payment processing fees, and other fees may change at any time and will be announced through the Platform or official VCGamers communication channels.

Fund Disbursement Fee

Each disbursement of funds by the Creator may be subject to a disbursement fee in accordance with the provisions applicable on the Platform.
The amount of the fund disbursement fee will be displayed before the disbursement process is carried out and can change at any time according to VCGamers policy.

Intellectual Property Rights

Content Ownership

Creators are required to guarantee that all content, works, names, logos, images, videos, audio, or other materials used or displayed through VCGamers Donate are the Creator's own property or have obtained valid permission from the relevant rights owner.
Creators are fully responsible for any form of copyright, trademark or other intellectual property rights violation arising from the use of content on the Platform.

License to VCGamers

By using the VCGamers Donate service, Creators grant VCGamers a non-exclusive, royalty-free, and limited right to display, use, store, distribute, or publish content uploaded on the Platform for the purposes of:

Provide VCGamers Donate service;
Displaying the Creator Donation page to Users;
Creator's promotional needs;
VCGamers service promotion and development needs.

Content Removal

Creators can change or delete content displayed on their Donation page at any time, as long as it does not conflict with any ongoing obligations or transactions.

Prohibition of Violation of Third Party Rights

Users are prohibited from uploading, using, copying, distributing, or displaying content that violates the copyright, trademark, patent, trade secret, or other intellectual property rights of others without proper permission.

Any violation of these provisions is the full responsibility of the party committing the violation.

VCGamers Intellectual Property Rights

All trademarks, logos, designs, systems, software, Platform displays, and content owned and managed by VCGamers are the intellectual property rights of VCGamers and are protected by applicable laws and regulations.

Users are prohibited from using, copying, modifying, distributing or exploiting VCGamers' intellectual property rights without written permission from VCGamers.

Platform Operations

VCGamers reserves the right to perform maintenance, updates, development, restrictions, temporary closures, or termination of part or all of the VCGamers Donate service at any time for operational, security, legal compliance, or service improvement purposes.

VCGamers strives to maintain service availability, but does not guarantee that the Platform will always be accessible without interruption, delay, system errors, or other technical problems.

VCGamers reserves the right to monitor, moderate, verify, or take other actions deemed necessary to maintain the security, stability, and integrity of the service.

VCGamers may suspend, limit, or deactivate accounts or access to services if violations of the Terms and Conditions, Privacy Policy, applicable legal provisions, or activities that have the potential to harm VCGamers or other Users are found.

VCGamers has the right to delete, hide, or limit content, donation pages, or activities that are deemed to violate the terms of service, contain elements of fraud, violate the law, or have the potential to harm other parties.

VCGamers has the right to verify data, identity, and other information provided by Users for security purposes, legal compliance, and preventing misuse of services.

Decisions taken by VCGamers regarding service operations, platform security, policy enforcement, and handling of violations are final in accordance with applicable provisions.

Consumer Complaints

If the User has questions, suggestions, complaints, or objections regarding the VCGamers Donate service, the User can contact VCGamers through the official customer service channels available on the Platform.

Every complaint received will be reviewed and followed up in accordance with the complaint handling procedures applicable at VCGamers.

VCGamers has the right to request additional information or documents required for the verification process and resolution of complaints.

Force Majeure (Forcing Circumstances)

About Force Majeure

VCGamers is not responsible for any delay, failure, or non-fulfillment of any or all obligations related to donation services if caused by circumstances beyond reasonable control (force majeure).
Force majeure includes, but is not limited to: natural disasters, fires, floods, earthquakes, war, riots, terrorism, government policies, disruptions to banking systems or payment gateways, disruptions to internet or electricity networks, cyber attacks, and other events beyond the Platform's control.
During the force majeure event, the performance of the affected obligations will be suspended until the situation returns to normal, and VCGamers will make reasonable efforts to restore the service.

Dispute resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Indonesia.
Any disputes that arise will be resolved first through deliberation to reach a consensus. If no resolution is reached within 30 (thirty) calendar days, resolution will be conducted through a competent court in the Republic of Indonesia.

Closing

These Terms and Conditions constitute the entire agreement between you and VCGamers regarding the use of the Donate feature on the Platform, and supersede all prior communications, understandings, or agreements, whether written or oral.

If one or more provisions of these Terms and Conditions are deemed invalid, void or unenforceable, then such provisions will not affect the validity of the other provisions which remain valid and binding.

No enforcement or delay in enforcement of any right or provision by VCGamers shall constitute a waiver of such right.
